This document supplements the Terms and Conditions, the Returns and Refunds Policy, the Privacy Policy, and the Cookies Policy of CubeVox. In the event of any conflict regarding this specific reservation offer, this document shall prevail with respect to what is specifically applicable to the reservation.
1. Program purpose
These Terms specifically govern the CubeVox reservation offer in its Early and Priority modalities. The purpose of the reservation is to grant the user a right of prior access, commercial priority, and/or creditable amount under the conditions published for this offer.
2. Reservation modalities
2.1 Early Reservation
The Early Reservation has a value of USD 49 and grants, subject to availability and applicable conditions, early access to the official purchase of the main CubeVox product, 100% credit of the amount paid toward the final price of such product, and an economic benefit of up to 15% less than the estimated reference price defined by CubeVox.
2.2 Priority Reservation
The Priority Reservation has a value of USD 99 and grants, subject to availability and applicable conditions, preferential access to the first purchase group of the main CubeVox product, 100% credit of the amount paid toward the final price of such product, and an economic benefit of up to 35% less than the estimated reference price defined by CubeVox.
2.3 Priority rule between modalities
Unless expressly indicated otherwise, the Priority modality shall have preference over the Early modality within the same round, batch, invitation group, or comparable commercial phase. This does not imply an absolute guarantee of immediate availability nor does it eliminate CubeVox's authority to administer the program according to territory, logistics, regulatory compliance, risk, and actual availability.
3. Legal nature and scope
The reservation does not by itself constitute a final purchase and sale of the device, does not transfer ownership of a product, does not amount to a shipment order, and does not generate an immediate obligation to deliver. The user acquires only the right, priority, benefit, or credit expressly indicated for the reserved modality.
The final purchase of the main product, when enabled, shall remain subject to acceptance of the order, availability, validation of the remaining payment, verification of data, enabled territory, and other commercial and legal conditions applicable at the time of that transaction.
4. Credit and application
Unless expressly indicated otherwise, the amount paid for the reservation shall be 100% creditable toward the final price of the main CubeVox product corresponding to the transaction for which the user is enabled or invited.
The credit shall not apply by default to accessories, modules, services, shipping, duties, local taxes, or other products different from the main device.
The credit shall not be cumulative with other reservations for the same unit, unless CubeVox expressly authorizes it.
The credit may only be used within the process, account, time window, and conditions communicated for the corresponding modality.
5. Disclosed economic benefit
The expressions “up to 15% less” and “up to 35% less” refer to the maximum economic benefit associated with each reservation modality in relation to the estimated reference price that CubeVox communicates for the main product in the applicable commercial phase.
The estimated reference price may vary according to product version, territory, commercial phase, taxes, logistics, import costs, or launch structure.
The benefit may be implemented as a direct discount, equivalent preferential condition, or equivalent commercial protection, at CubeVox's discretion and according to the final sale configuration.
If, at the time of the final purchase, there is a general public condition that is equal to or better for the same product and territory, CubeVox may apply the most favorable non-cumulative condition.
6. Priority, invitation, and loss of preference
When CubeVox enables a purchase instance for reservation holders, it may send invitations, notices, or enablements by email, user account, website, or other reasonable contact channels.
Each invitation may be subject to a specific time window to:
confirm user data;
choose the available version;
complete the remaining payment;
accept the specific conditions in force for that stage.
If the user does not act within the indicated period, CubeVox may consider the priority, batch, preferential condition, or benefit of that round expired, without any obligation to maintain the same position, the same lot, or the same estimated date for a later instance, unless expressly indicated otherwise.
7. Public access, territories, and commercial enablement
The reservation program may be visible and publicly accessible through the site. However, CubeVox may promote, prioritize, enable, limit, defer, or reject reservations and/or final purchases according to territory, availability, regulatory compliance, logistics, payment methods, risk management, or commercial strategy.
CubeVox may commercially prioritize certain regions, including Latin American markets, without implying any obligation to simultaneously enable all territories for invitations, dispatch, or final sale.
8. Changes, delays, and availability
During the development, validation, manufacturing, or launch of the product, CubeVox may introduce non-material changes in design, finishes, materials, components, software, firmware, packaging, interfaces, or equivalent or superior features, without this by itself giving rise to a right to withdraw or obtain a refund.
The dates, windows, or timeframes for launch, manufacturing, availability, or invitation linked to the reservation shall be interpreted as estimates, unless CubeVox expressly indicates that a given date is mandatory or guaranteed.
The reservation does not guarantee unlimited availability nor the right to demand a specific configuration outside the versions, lots, or territories effectively enabled by CubeVox for the corresponding stage.
9. Refunds and cancellations
As a general rule, the reservation is non-refundable. However, CubeVox may admit a refund when any of the following circumstances occurs:
final cancellation of the product or the reservation program by CubeVox;
material adverse change with respect to the characteristics or principal uses expressly announced for this offer;
extraordinary delay beyond the threshold or longstop date communicated by CubeVox for the applicable program;
rejection or cancellation of the reservation for internal causes attributable to CubeVox and without valid assignment of the contracted modality;
any case in which a refund is required by applicable mandatory law.
When a refund proceeds, CubeVox shall issue it, in principle, through the same original payment method or through an equivalent reasonable mechanism. The reservation does not generate interest, monetary adjustment, or yields, unless otherwise required by law.
10. Personal nature and restrictions
Unless expressly authorized by CubeVox, the reservation shall be personal in nature and may not be transferred, resold, assigned, or exchanged for cash. CubeVox may establish reasonable limits per user, account, email, payment method, address, territory, or combination of these criteria in order to prevent abuse, duplication, fraud, hoarding, or unauthorized resale.
Reservations made in breach of those limits or by abusive use of the site may be suspended, adjusted, or canceled.
11. Relationship with other documents
This reservation offer is governed by this document and, in a complementary manner, by the Terms and Conditions, the Returns and Refunds Policy, the Privacy Policy, and the Cookies Policy of CubeVox, in addition to any communication or specific condition validly published for this modality.
In the event of any conflict between this document and the general Terms and Conditions of the site with respect to this specific reservation offer, this document shall prevail in whatever is specifically applicable to the reservation.
