General framework for the CubeVox website regarding access, use, accounts, operations offered through the site, reservations, purchases, limitations, changes to terms, and contact.

This document governs the types of operations that CubeVox may offer through the site, including reservations, purchases, and special campaigns subject, where applicable, to specific supplementary conditions.

1. Identity of the Website Owner

This website, commercially identified as CubeVox, is operated by Accuracy Quality Audio, Inc., a corporation incorporated in Delaware, United States.

Communications, requests, and non-judicial notices will be handled through the contact channels published on the site. When, due to the nature of the matter, a postal or return address is required, CubeVox will provide it in writing in the context of the corresponding case.

2. Acceptance of the Terms

By accessing the site, browsing it, creating an account, filling out forms, paying for an advance reservation, making a purchase, or using any functionality of CubeVox, you agree to be bound by these Terms and Conditions, together with the Privacy Policy, Cookie Policy, Refund and Returns Policy, and, where applicable, the CubeVox Reservation Terms and/or the specific terms of a special campaign.

If you do not agree with these Terms, you must not use the site or carry out operations through it. Continued use of the site after the publication of non-material changes will be deemed acceptance of the then-current version, except with respect to operations already completed, which will be governed by the version applicable on their confirmation date.

3. Scope and Commercial Modalities

Reservation Advance Reservation

Applies to early-access programs, purchase-priority programs, or amount-crediting programs under the conditions expressly stated in each offer.

Purchase Products and Accessories

Applies to orders for physical goods or other products offered through the site, subject to availability, validation, and acceptance.

3.1 Advance Reservation

An advance reservation is an early-access modality subject to specific conditions. Unless expressly stated otherwise in the relevant offer, the reservation:

  • does not by itself constitute a final purchase of the product;
  • does not transfer ownership or create an immediate obligation to deliver;
  • does not constitute a shipping order for the device;
  • grants only the right, priority, benefit, or credit expressly stated at the time of reservation;
  • will, as a general rule, be non-refundable except in the cases specifically provided for that modality;
  • may be subject to limits, deadlines, loss of priority, crediting rules, and non-transferability depending on the applicable program.

The detailed terms of each reservation program are set out in Section 7 of these Terms and, where applicable, in the CubeVox Reservation Terms.

3.2 Purchases of Products and Accessories

Any purchase made through the site will be subject to these Terms, the Refund and Returns Policy, the Shipping/Delivery Policy, and, where applicable, the Warranty/After-Sales Support Policy in effect at the time of the transaction.

3.3 Special Campaigns

Certain campaigns, launch programs, special advance-sale programs, or equivalent modalities may be subject to specific supplementary conditions. Likewise, CubeVox may promote, enable, prioritize, or limit certain operations based on territory, availability, regulatory compliance, logistics, or risk management. In the event of a conflict, those specific conditions will prevail with respect to the transaction to which they apply.

3.4 Order of Precedence of Documents

These Terms constitute the general framework of the site. For each transaction, the specific policies or conditions applicable by their nature will also apply. In the event of a contradiction, the following shall prevail, in this order: the specific conditions of the transaction, the applicable specific policy, and, lastly, these general Terms.

4. Capacity to Contract and Use of the Site

Only persons with sufficient legal capacity to contract under the mandatory legislation applicable in each case may carry out transactions.

By using the site, you represent that:

  • the information you provide is true, complete, and up to date;
  • you will use the site in good faith and for lawful purposes;
  • you will not carry out fraudulent, simulated, or unauthorized transactions;
  • you will not use the site in a manner that affects its operation, security, or availability.

CubeVox may reject, suspend, or cancel accounts, reservations, orders, or access when it detects indications of fraud, abuse, breach of contract, unauthorized use of the site, material inconsistencies in the information provided, or reasonable operational/commercial risk.

5. Account Registration and User Data

To access certain functionalities, CubeVox may require the creation of an account or the provision of personal, contact, billing, or shipping data.

You are responsible for maintaining the confidentiality of your credentials, verifying that your data is correct, and updating any relevant change to your contact, billing, or shipping data. CubeVox will not be liable for damages arising from incorrect, incomplete, or outdated information provided by the user, or for unauthorized access resulting from the user’s own negligence.

6. Site Information and Availability

CubeVox seeks to keep the information on the site clear and up to date. However, images, renders, videos, prototypes, descriptions, colors, finishes, interfaces, technical specifications, packaging, included accessories, or integrations may be illustrative or referential.

CubeVox reserves the right to correct typographical errors, inaccurate descriptions, incomplete specifications, or manifest errors in prices, benefits, or availability.

Likewise, the site and certain functionalities may be subject to temporary interruptions, maintenance work, updates, technical limitations, or unavailability of third-party services, without this by itself constituting a breach, except where applicable law provides otherwise.

7. Advance Reservations

7.1 Nature and General Scope

When a user pays for an advance reservation, they acquire only the right, priority, commercial benefit, or credit expressly stated in the offer published at the time of the transaction. Unless expressly stated otherwise, the reservation does not transfer ownership of a product, does not create an immediate obligation to deliver, and does not constitute a final purchase of the device.

7.2 General Conditions of the Reservation

As a general rule, the reservation will be personal in nature, subject to the reasonable limits established by CubeVox for each program, and may only be used in accordance with the conditions specifically stated for the corresponding modality. Unless expressly stated otherwise, the amount paid for the reservation will be 100% creditable toward the final price of the main reserved product and will not, by default, apply to accessories or products other than the main device.

As a general rule, the advance reservation is non-refundable, except in the cases expressly provided for the applicable modality, where CubeVox cancels the program or the reserved product, in the event of material adverse changes with respect to what was expressly announced, in the event of extraordinary delays defined for the program, or where a refund is required by the mandatory applicable legislation.

7.3 Changes, Delays, and Priority

During the development, validation, manufacturing, or launch of the product, CubeVox may introduce non-material changes in design, materials, components, software, firmware, packaging, interfaces, or equivalent or superior features, without this by itself giving rise to a right to withdraw or obtain a refund. Dates or launch, manufacturing, or availability windows provided in the context of a reservation shall be interpreted as estimates, unless expressly stated otherwise.

When a reservation program contemplates a future invitation to complete the purchase, CubeVox may establish time windows, priority rules, territorial limits, crediting conditions, circumstances of loss of preference, and other reasonable parameters for the administration of the program.

7.4 Specific Reservation Terms

The detailed conditions of each reservation modality, including tiers, prices, priority, benefits, limits, terms, expirations, crediting rules, transferability, consequences of user inaction, territorial restrictions, and any additional cases of refund or cancellation, are further governed by the CubeVox Reservation Terms, which form an integral part of this general framework.

8. Purchases of Products and Accessories

8.1 Order and Acceptance

The placement of an order by the customer constitutes an offer to purchase. The sale shall only be deemed completed when CubeVox accepts the order, validates payment, confirms reasonable availability, and there are no manifest errors, inconsistencies, or suspicions of fraud. Automatic receipt of an order acknowledgment, receipt confirmation, or preliminary confirmation shall not by itself imply definitive acceptance of the transaction, unless CubeVox expressly states otherwise.

8.2 Availability, Limits, and Order Configuration

All products will be offered subject to availability. CubeVox may limit quantities, reject unusual orders, restrict certain variants, or cancel orders where there is lack of stock, inventory error, logistical impossibility, reasonable commercial restriction, suspicion of unauthorized resale, or risk of fraud.

8.3 Order Data and Duty to Review

The customer is responsible for reviewing the order details before confirming the transaction, including product, version, quantity, delivery address, billing information, and payment method. CubeVox will not be liable for errors arising from incorrect information provided by the customer or for additional costs derived from corrections, reshipments, or subsequent procedures attributable to the customer.

8.4 Verification, Fraud Prevention, and Rejection of Transactions

CubeVox may request additional verifications of identity, payment method ownership, billing, destination, order consistency, or any other information reasonably related to fraud prevention, regulatory compliance, or risk management. If the user does not provide the requested information within the indicated period, or if material inconsistencies remain, CubeVox may reject or cancel the transaction.

8.5 Cancellation or Adjustment by CubeVox

Before dispatch, CubeVox may cancel or adjust a transaction where there is a manifest error, subsequent unavailability, impossibility of performance, fraud, abusive use of the site, regulatory restriction, publication error, supply problems, or any other reasonable cause that prevents or counsels against continuing the transaction under the originally intended terms.

8.6 Refund in Case of Cancellation

If an order is canceled after payment has been collected, CubeVox will refund the amount actually charged using the same payment method or an equivalent mechanism, except where technically impossible or where a different legal rule applies. Posting times will also depend on the issuer, financial institution, or payment provider involved.

9. Prices, Currency, Taxes, and Errors

9.1 Currency

Prices on the site shall be expressed in USD, unless expressly stated otherwise.

9.2 Taxes and Charges

The published prices include the amounts, charges, or taxes that CubeVox collects at checkout. Local taxes, VAT, import duties, customs charges, withholdings, or destination-country charges, if applicable, shall be borne by the buyer unless expressly stated otherwise.

9.3 Manifest Price or Publication Error

If, due to a material error, a manifestly incorrect price or benefit is published, CubeVox may void the transaction before dispatch or before definitive order acceptance, informing the user of the situation and offering, as appropriate, cancellation with refund or continuation of the transaction under the correct conditions.

10. Payment Methods and Verifications

CubeVox may offer different payment methods through its own providers or third parties. Every transaction will be subject to payment method validation, anti-fraud controls, issuer authorization, identity verification where necessary, and reasonable internal controls.

CubeVox may reject or cancel transactions when it detects inconsistencies between identity, billing, payment method ownership, shipping address, or other relevant data.

11. Shipping and Delivery

When CubeVox enables the sale and dispatch of physical products, shipments will also be governed by the Shipping/Delivery Policy then in effect.

  • Preparation, dispatch, and delivery times will be estimates unless expressly stated otherwise.
  • Shipping data must be correct and complete; costs arising from errors, absences, reshipments, or rejections attributable to the customer may be charged to the customer.
  • Allocation of the risk of loss or damage during transport shall be subject to the applicable policy and the mandatory legislation applicable in each case.

12. Cancellations

12.1 Cancellation by the Customer

The customer may request cancellation of a reservation or order in accordance with the Refund and Returns Policy, the specific information of the applicable offer, and the mandatory legislation applicable in each case.

12.2 Cancellation by CubeVox

CubeVox may cancel a reservation, order, or account where there is fraud, reasonable suspicion of fraud, breach of these Terms, manifest pricing error, insurmountable unavailability, impossibility of verification, serious technical problems, legal or regulatory restrictions, or force majeure.

13. Warranties

Physical products sold by CubeVox may be subject to mandatory legal warranty, where applicable, and/or an additional commercial warranty if expressly offered. The scope, duration, exclusions, and applicable procedure will be set out in the specific warranty and after-sales support policy in effect at the time of sale.

In no event shall this clause limit non-waivable consumer rights that may not be validly excluded or restricted under the mandatory applicable legislation.

14. Regulatory Compliance and Restrictions

Certain products, functions, accessories, shipping modalities, payment methods, or related services may not be available in all territories. CubeVox may limit, suspend, or reject transactions where necessary for regulatory, logistical, technical, commercial compliance, or risk-management reasons.

The user shall be responsible for verifying whether the import, use, or acquisition of the product in their jurisdiction requires authorizations, payments, registrations, adaptations, or special conditions not expressly assumed by CubeVox.

15. Intellectual Property

All content on the site, including trademarks, trade names, logos, designs, photographs, renders, videos, texts, interfaces, software, documentation, audiovisual material, and other elements of the site, belongs to CubeVox, Accuracy Quality Audio, Inc., or its licensors, and is protected by applicable intellectual property laws.

It is prohibited to reproduce, copy, distribute, publish, modify, exploit, or use such content without prior, express, written authorization.

16. Permitted Use of the Site

The user agrees not to breach the security of the site, introduce malicious code, automate unauthorized access, engage in unauthorized systematic scraping, impersonate identities, or interfere with legitimate operations of other users.

17. Privacy and Data Processing

The processing of personal data is governed by the CubeVox Privacy Policy. By using the site and providing data, the user declares that they have read and understood that policy.

18. Limitation of Liability

To the maximum extent permitted by applicable law, CubeVox shall not be liable for indirect losses, loss of profits, loss of opportunity, loss of data, consequential damages, temporary site interruptions, errors by third-party providers, reasonable logistical delays, or minor differences between illustrative material and the final product that do not substantially affect the main use expressly communicated.

This clause shall not limit consumer rights that may not be validly excluded or restricted under the mandatory applicable legislation.

19. Force Majeure

CubeVox shall not be liable for failures or delays arising from events beyond its reasonable control, including labor disputes, supplier interruptions, government restrictions, natural disasters, logistical crises, third-party cyber incidents, or other force majeure events.

20. Modifications to the Terms

20.1 Temporal Rule of Application

Each reservation, purchase, or transaction shall be governed by the Terms in effect on the date such transaction was confirmed, unless a mandatory rule provides otherwise, the change benefits the customer, or the customer expressly accepts new conditions for a pending transaction.

20.2 Publication and Notice

CubeVox may update these Terms at any time. Updated versions shall become effective upon publication on the site or from the date expressly indicated. When changes are material and affect registered users, prior buyers, or holders of active reservations, CubeVox may notify them through a notice on the site, email, user panel, or another reasonable contact channel.

21. Partial Invalidity and Continuing Validity

If any provision of these Terms is deemed invalid, illegal, or unenforceable, this shall not affect the validity of the remainder of the document, which shall remain in force to the fullest extent permitted.

The failure to exercise, or delay in exercising, any right by CubeVox shall not be construed as a waiver of such right.

22. Governing Law and Jurisdiction

These Terms shall be governed by the laws of the State of Delaware, United States, except insofar as mandatory consumer-protection or distance-contracting rules apply and may not validly be excluded to the detriment of the user.

Any dispute shall be submitted to the competent courts of the State of Delaware, United States, without prejudice to any rights that may correspond to the consumer under the mandatory applicable legislation.
